Terms of Use

These terms apply when you use Dibs. By using the app you accept them.

1. Who you are dealing with

Dibs is provided by Kevin Baur, a sole trader, Hochstraß 542, 3033 Klausen-Leopoldsdorf, Austria, reachable at apps@kevin-baur.com. Full provider details are in the Imprint.

2. Your account

An anonymous account is created for you when you first open the app. You may add an email address and password so you can sign in elsewhere. Keep your password to yourself; you are responsible for what happens under your account.

You must be at least 14 years old, or older where your country sets a higher age for agreeing to digital services on your own. If you are under 18, purchases need the consent of a parent or guardian.

Your collector handle and profile picture are visible to others. Do not use a handle or picture that impersonates someone else, that is offensive, or that infringes someone's rights.

3. Photographing cars: your responsibility

You decide what you photograph and what you upload or share. That decision is yours, and so are its consequences.

The app helps by obscuring the licence plate of the car you selected, but it does not catch everything: not plates on other cars, and never faces. It can also be switched off for any given shot, and on older devices it is unavailable. Details are in the Privacy Policy.

5. Content and moderation

What is reviewed. Collector handles, profile pictures and the cut-out vehicle images are publicly visible. Anything listed in section 4 is not allowed. In addition, only real vehicles count towards the leaderboards, not model cars, screens or printouts.

How it is reviewed. During identification, the recognition automatically estimates whether a real vehicle is in front of the camera. Reports, and any measure against content or an account, are decided by me, a human. A report is a request for review and never leads to a measure by itself.

Reporting. In the app you can report and block collectors and content. If you do not use Dibs, report illegal content by email to apps@kevin-baur.com. Please include the collector handle or the link to the content, the reason why you consider it illegal, and your name and email address. If you report by email, you receive a confirmation of receipt and are told what I decided.

Possible measures. A find can be taken out of the leaderboard count or hidden, a handle or profile picture can be removed, and an account can be suspended or deleted. I choose the mildest measure that is sufficient.

Reasons. If a measure affects you, you are told in the app or, if you have added an email address, by email which content is affected, what was decided and why.

Objecting. If you think a decision is wrong, write to apps@kevin-baur.com and name the content concerned. I will then review it again. You can also go to court at any time.

Point of contact. The single point of contact under the EU Digital Services Act, for authorities as well as for users, is apps@kevin-baur.com. You can write in German or English.

6. Your content

Your photos stay yours. To run the app I need permission to store, process and display them for that purpose, for example to show your cut-out vehicle images to other collectors, which is how the collection feature works. That permission ends when you delete the content or your account, apart from copies that others have already saved or shared outside the app, which I cannot reach.

7. Dibs+

Dibs+ is an optional purchase that unlocks the map, lifts the daily limit of the free version, removes ads, backs up your original photos and enables exports. It is billed through the App Store or Google Play. Prices are shown in the app before you buy, in your local currency.

Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Deleting the app does not cancel a subscription. Cancel through your Apple or Google account settings. Cancelling has to happen there, not in Dibs. Refunds are also handled by Apple or Google under their rules, not by me.

Fair use. Dibs+ is meant for personal collecting. Every scan costs me money, so limits apply to every plan, including the one time purchase: up to 200 scans per day and up to 1,500 scans within any 30 days. When you reach a limit, scanning resumes once the period has passed. Everything else keeps working, and you can still enter a find yourself. I may adjust these limits only under the conditions in the next paragraph.

Feature changes. I may change the features of Dibs+ and the fair use limits only for a valid reason: a marked rise in the cost of identification, new technical or legal requirements, the security of the service, or preventing abuse. Such a change costs you nothing extra, and I announce it in the app at least 30 days in advance. For a subscription it applies from the next renewal at the earliest. If it makes your use more than slightly worse, you can end the contract free of charge within 30 days; your statutory claims arising from that remain.

Price changes. I may change prices for future billing periods. Apple or Google tell you in advance about a price increase for a running subscription, and you can cancel before it takes effect. A change never reaches back into a period you have already paid for, and never into a one time purchase.

Bonus scans. Extra scans you receive for watching an ad or for inviting someone are a voluntary bonus. A scan from an ad counts for the day on which you watched it and lapses at the next daily reset; it cannot be saved up. Bonus scans have no cash value, cannot be transferred, may be changed or ended at any time, and can be removed where they were obtained by abuse.

One time purchase. Where a one time purchase is offered, it gives you access for as long as Dibs is operated, not for your own lifetime. If I shut Dibs down, I will announce that in the app at least three months in advance.

8. Availability and warranty

I do my best to keep Dibs working, but I cannot promise it will be available without interruption, always identify a car correctly, or work on every device. Free features may change or be removed.

Your statutory warranty rights are not affected by this. The statutory warranty for digital services applies to Dibs+: if something promised is missing or does not work, you are entitled to have me fix it and, if that fails, to a price reduction or to ending the contract. Car identification is automatic and can be wrong. Treat the result as a suggestion, not a fact.

9. Liability

I am liable without limit for damage I cause intentionally or through gross negligence. The same applies to personal injury, whatever the degree of fault, and to liability under the Austrian Product Liability Act. I am not liable for other damage that I cause through slight negligence only.

10. Ending it

You can stop using Dibs at any time and delete your account in the app. I may suspend or remove an account that breaks these terms, particularly for illegal content or harassment, or where that is needed to protect the service or other users. How you are told about it and how you can object is set out in section 5. Deleting your account does not cancel a subscription; do that with Apple or Google first.

11. Changes to these terms

The date at the top of this page shows the current version. I announce a change in the app at least 30 days before it takes effect and say what is changing. In that announcement I point out specifically that you can object, and that the new version applies to you if you have not objected by the time it takes effect. If you object, you can stop using Dibs free of charge; a period you have paid for then runs to its end under the old terms.

I do not use this route to change the price or the essential features of a paid Dibs+. Section 7 alone applies to that.

12. Applicable law

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you can bring proceedings in the courts there.

13. Names and trademarks

Dibs, its design, code and artwork belong to me. Dibs is not affiliated with, sponsored by or endorsed by any vehicle manufacturer. Brand and model names belong to their owners and appear only to name the vehicles you find.
